1. Acceptance of Terms

These Terms of Use (“Terms”) govern your use of breakfastcruise.com (the “Website”) and the jet ski rentals and guided jet ski tours offered by NEW YORK CITY JETSKI, LLC (“we”, “us”, “our”). By using the Website or submitting a booking request, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.

2. Our Services

We provide hourly jet ski rentals and guided jet ski tours on the waters of New York Harbor, including routes near the Statue of Liberty, Lower Manhattan and the Brooklyn Bridge. Routes, durations and stops shown on the Website are examples; the actual route may change on the day because of weather, water conditions, marine traffic, security zones or instructions from authorities.

3. Booking Requests and Confirmation

Submitting a form on the Website is a request, not a confirmed booking. A booking is confirmed only after we contact you and confirm the date, time, price and meeting point by phone, SMS or e-mail. Please make sure the contact details you provide are accurate.

4. Prices and Payment

Prices on the Website are starting prices per jet ski and are shown for information. The final price for your date, ride and group is confirmed to you before you pay. Unless stated otherwise, prices are in U.S. dollars. Payment is made through a secure payment link or on arrival, as agreed when your booking is confirmed. A refundable security deposit may be required for rentals.

5. Cancellations, Changes and Weather

• You may change or cancel your booking free of charge up to 48 hours before the start time.
• Changes requested later are subject to availability; late cancellations and no-shows may not be refundable.
• If we cancel because of weather, water conditions or safety reasons, you can reschedule free of charge or receive a full refund.
• Please arrive 30 minutes before your start time. Late arrival may shorten your ride so that following groups are not delayed.

6. Rider Requirements

• Jet ski drivers must be at least 18 years old and present a valid government-issued photo ID.
• Passengers aged 8 and older may ride with an adult driver. Minors must be accompanied by a parent or legal guardian who signs on their behalf.
• Each rider must complete our safety briefing and sign a participation agreement and liability waiver before riding.
• Operators must meet New York State boating safety certificate requirements that apply to personal watercraft; we explain these requirements before your ride.
• Riders must not be under the influence of alcohol or drugs and should inform us of any medical condition that could affect their safety.

7. Safety Rules and Conduct

For everyone’s safety you agree to wear the provided life jacket at all times, follow your guide’s instructions, respect speed limits, no-wake and security zones, keep a safe distance from other vessels and swimmers, and follow U.S. Coast Guard and local rules. Our guides may end a ride without refund if a rider acts unsafely or ignores instructions.

8. Assumption of Risk

Riding a jet ski is a physical activity with inherent risks, including falls into the water, collisions, waves, wakes and changing weather. By participating you accept these risks to the extent permitted by law. The participation agreement and waiver signed on site form part of your contract with us.

9. Damage to Equipment

You are responsible for using our jet skis and equipment with reasonable care. Damage caused by reckless use, breaking safety rules or ignoring the guide’s instructions may be charged to the renter, up to the amount of the repair cost or the security deposit agreed at booking.

10. Photos and Media

Our guides may take photos or videos during tours for you to keep. We will use images of identifiable riders on the Website or in advertising only with their permission.

11. Use of the Website

You may use the Website for personal, non-commercial purposes. You agree not to submit false or misleading information, interfere with the Website’s operation or security, use automated means to collect data from it, or use it for any unlawful purpose.

12. Intellectual Property

The texts, design, logos and other content of the Website belong to NEW YORK CITY JETSKI, LLC or its licensors and are protected by copyright and trademark laws. You may not copy, modify or distribute them without our written permission.

13. Disclaimers

We work to keep the information on the Website accurate and up to date, but it is provided “as is” and may change without notice. Photos are for illustration; specific jet ski models, views and landmarks visited may vary.

14. Limitation of Liability

To the maximum extent permitted by law, NEW YORK CITY JETSKI, LLC is not liable for indirect, incidental or consequential damages arising from your use of the Website. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in New York County, New York, unless applicable law requires otherwise.

16. Changes to These Terms

We may update these Terms from time to time. The “Effective date” at the top of this page shows the latest version. The Terms in force when your booking is confirmed apply to that booking.
